Réglement
1. ELIGIBILITY: Denim for Life Sweepstakes (the »Sweepstakes ») is open only to legal residents of Canada who are atleast eighteen (18) years old at the time of entry. Entries originating fromoutside of Canada are not eligible. This Sweepstakes is void wherever prohibited,taxed or restricted by law.
Employees of Jean Machine (“Sponsor”) andits affiliates, prize suppliers and advertising and promotional agencies, aswell as their immediate families (spouses, parents, children, siblings andtheir spouses) and individuals living in the same households as such employeesare ineligible.
Participation constitutes entrant’s full andunconditional agreement to be bound by these Official Rules and Sponsor’sdecisions, which are final and binding in all matters related to the Sweepstakes.Winning a prize is contingent upon fulfilling all requirements set forthherein.
2. TIMING: The Sweepstakesbegins on October 8, 2015 at 12:00 a.m. Eastern Time (« ET ») and endson November 19, 2015 at 11:59 p.m. ET (the « Entry Period »). Jean Machine’s computer is the official time keeping device for thisSweepstakes.
3. HOWTO ENTER: No purchase is necessary. A purchase will not increase yourchances of winning. During the Entry Period, entry into the Sweepstakes can becompleted only by: completing an online entry form available atwww.jeanmachine.com or in person by completing an in-storeballot at a participating Jean Machine location in Ontario. No other form ofentries outside of these ways to enter will be accepted, like mailed entries,telephone entries, etc. By entering into the Sweepstakes, each participantacknowledges that he/she agrees to the terms and conditions of these OfficialRules.
4. LIMITATIONS: Eachparticipant may enter the Sweepstakes one (1) time. Each participant may beeligible for additional entries by following the online instructions on theonline entry page. Each participant is only eligible to win this Sweepstakesone (1) time. Multiple entrants are not permitted to share the same emailaddress. Any attempt by any entrant to obtain more than the stated number ofentries by using multiple/different email addresses, identities, registrationsand logins, or any other methods will void that entrant’s entries and thatentrant, at Sponsor’s sole discretion, may be disqualified. Sponsor is notresponsible for lost, late, incomplete, invalid, unintelligible or misdirectedregistrations, which will be deemed ineligible and disqualified. In the eventof a dispute as to any registration or entry, the authorized account holder ofthe email address used to register will be deemed to be the registrant. The »authorized account holder » of an email address, is defined as thenatural person assigned an email address by an Internet access provider, onlineservice provider or other organization responsible for assigning email addressesfor the domain associated with the submitted address. Potential winner may berequired to show proof of being the authorized account holder. No facsimile,mechanical reproduced, altered or forged entries are permitted. Proof of entrydoes not constitute proof of receipt by Sponsor.
5. WINNING& VERIFICATION: Sponsor will randomly select one (1) potentialSweepstakes winner from all eligible entries received during the Entry Period.Potential winner will be announced at Toronto Event hosted by Jean Machine at YorkdaleMall on November 26, 2015. If potential winner is not present, he/she will benotified by e-mail or telephone within two (2) days of selection. Eachpotential winner shall be required to sign, notarize and return an Affidavit ofEligibility, Liability & Publicity Release (the “Affidavit”), which must bereceived by Sponsor within ten (10) days of the date notice or attempted noticeis sent, in order to claim his/her prize. If a potential winner cannot becontacted, fails to sign and return the Affidavit within the required timeperiod, or a prize is returned as undeliverable, the potential winner forfeitsthe prize.
Upon prize forfeiture, no compensation willbe awarded. If any winner is considered a minor in his/her jurisdiction ofresidence, such prize will be delivered to the minor’s parent/legal guardianand awarded in the name of the parent/legal guardian. In the event that thepotential winner is disqualified for any reason, Sponsor will award the prizeto an alternate winner by random drawing from among all remaining eligibleentries. There will be two (2) alternate drawings after which the prize will remainunawarded.
Sponsor’s decisions as to the administrationand operation of the Sweepstakes and the selection of potential winners shallbe final and binding in all matters related to the Sweepstakes. Potentialwinners must continue to comply with all terms and conditions of these OfficialRules; and winning is contingent upon fulfilling all requirements.
6. PRIZE: The prize awardedto the winner consists of the right to receive four (4) pairs of jeans, percalendar year, of any brand of jeans available for purchase at Jean Machine,in-store or online for life with the express understanding that »life » shall be deemed to mean: (i). twenty (20) years; (ii). untilthe winner is deceased, or (iii). until Jean Machine ceases business orcarrying the products in issue; whichever period is shorter. Theapproximate retail value of the winner’s prize, dependent upon the winner’ssurvival for twenty (20) consecutive years, is $8,000.00. Verification ofaddress and proof of life will be conducted or may be required to be producedby winner each year, prior to Sponsor issuing prizes.
Upon verifying winner, Sponsor will provide winnerwith instructions on how to redeem and receive their prizes. Winner is solelyresponsible for following instructions and redeeming their annual prizes, andSponsor is not responsible for providing reminders, nor will Sponsor providereminders. Failure by winner to redeem any annual prize shall constitute aforfeiture of the prize for the calendar year or years in issue, and thereshall be no right to collect forfeited prizes retroactively for any missedyear(s).
Winner may choose any size, type, style, orgender of jeans available in-store or online at Jean Machine. Prizes will beforwarded in accordance with Sponsor’s standard shipping policies in effect atthe time. Exchanges of jeans for reasons other than defects are only permittedif returned within fourteen (14) days of receipt and only if in new, unworncondition.
Prizes must be redeemed by the winner by theend of business (5:00pm EST) every December 31st, or the prize forthat calendar year shall be deemed forfeited. Prizes cannot be extended beyondthe validity dates. Prizes have no cash equivalent and all prizes arenon-transferable. No substitution will be made except as provided herein at theSponsor’s sole discretion. Sponsor reserves the right to substitute the prizefor one of equal or greater value if the designated prize should becomeunavailable for any reason. Winner is solely responsible for all taxes and feesassociated with prize receipt and/or use.
Prizes have no cash or redemption value, andinclude service charge and sales tax. Prizes are not transferable and may notbe transferred, assigned or bequeathed, and may not be transferred upon deathor otherwise by operation of law. At any point during the 20 year prize term,Sponsor reserves the right, in its sole option, but shall not have theobligation, to offer winner a cash buy-out to terminate fulfillment of theprize term.
7. ODDSOF WINNING: Odds of winning the prize depend on the number ofeligible entries received during the Sweepstakes Entry Period.
8. PUBLICITY: Except whereprohibited by law, by accepting the prize, winner grants to Sponsor and itsagents the right to use winner’s name, image, likeness, photograph, voice,opinions and/or hometown, state, and biographical information for promotionalpurposes in perpetuity, worldwide, in any media, including, without limitation,on the Internet or via wireless application protocol or any other means,without further permission, payment or consideration.
9. GENERALCONDITIONS: Sponsor reserves the right to cancel, terminate, suspendand/or modify the Sweepstakes, or any part of it, if any fraud, technicalfailures or any other factor beyond Sponsor’s reasonable control impairs theintegrity or proper functioning of the Sweepstakes, as determined by Sponsor inits sole discretion. In such event, Sponsor reserves the right to award prizesat random from among the eligible entries received up to the time of theimpairment. Sponsor reserves the right in its sole discretion to disqualify anyindividual it finds to be tampering with the entry process or the operation ofthe Sweepstakes or to be acting in violation of these Official Rules or anyother Sweepstakes or in an unsportsmanlike or disruptive manner. Any attempt byany person to deliberately undermine the legitimate operation of theSweepstakes may be a violation of criminal and civil law, and, should such anattempt be made, Sponsor reserves the right to seek damages from any suchperson to the fullest extent permitted by law. Sponsor’s failure to enforce anyterm of these Official Rules shall not constitute a waiver of that provision.Sponsor is not responsible if Sweepstakes cannot take place or if the prizecannot be awarded due to delays or interruptions due to acts of God, acts ofwar, natural disasters, weather or acts of terrorism. Entrants who do notcomply with these Official Rules, or attempt to interfere with this Sweepstakesin any way shall be disqualified.
10. RELEASE: By participating,entrants and winners hereby agree to release and hold harmless Jean Machine,and its parent company, subsidiaries, affiliates, suppliers, distributors,representatives, servants, employees, merchants, vendors,advertising/Sweepstakes agencies and each of their respective parent companiesand each such company’s officers, directors, employees, representatives,servants, merchants, and agents (collectively, the “Released Parties”) from andagainst any claim or cause of action, for any loss, harm, damage, injury, costor expense, whatsoever including, but not limited to, personal injury, death,or damage to or loss of property, arising out of or in connection withpreparation for, travel to or participation in the Sweepstakes or possession,acceptance, receipt, use or misuse of any prize or participation in anySweepstakes-related activity and for any claims based on publicity rights,defamation or invasion of privacy and merchandise delivery.
11. LIMITATIONSOF LIABILITY: The Released Parties are not responsible for: (1) anyincorrect or inaccurate information, whether caused by entrants, printingerrors or by any of the equipment or programming associated with or utilized inthe Sweepstakes; (2) technical failures of any kind, including, but not limitedto malfunctions, interruptions, or disconnections in cellular networks,internet, the scanning devices, phone lines or network hardware or software;(3) unauthorized human intervention in any part of the entry process or theSweepstakes; (4) technical or human error which may occur in the administrationof the Sweepstakes or the processing of entries; or (5) any injury or damage topersons or property which may be caused, directly or indirectly, in whole or inpart, from entrant’s participation in the Sweepstakes or receipt or use ormisuse of any prize. If for any reason an entrant’s entry is confirmed to havebeen erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’ssole remedy is another entry in the Sweepstakes, provided that if it is notpossible to award another entry due to discontinuance of the Sweepstakes, orany part of it, for any reason, Sponsor, in its sole discretion, may elect tohold a random drawing from among all eligible entries received up to the dateof discontinuance for the prize offered herein. No more than the stated numberof prizes will be awarded. In the event that production, technical, seeding,programming or any other reasons cause more than the stated number of prizes asset forth in these Official Rules to be available and/or claimed, Sponsorreserves the right to award only the stated number of prizes by a randomdrawing among all legitimate, unawarded, eligible prize claims.
12. APPLICABLELAW & DISPUTES: This Sweepstakes is governed exclusively by the lawsof Canada and the province of Ontario. Except where prohibited by applicablelaw, participants in this Sweepstakes agrees that: (1) any and all disputes,claims and causes of action arising out of or related to this Sweepstakes orany prize awarded shall be resolved individually, without resort to any form ofclass action, and exclusively by the appropriate provincial court located inthe province of Ontario, Canada; and; (2) any and all claims, judgments andawards shall be limited to actual out-of-pocket costs incurred, including costsassociated with entering this Sweepstakes, but in no event attorneys’ fees; and(3) under no circumstances shall entrant be permitted to obtain awards for, andentrant hereby waives all rights to claim, indirect, punitive, incidental andconsequential damages and any other damages, other than for actualout-of-pocket expenses, and any and all rights to have damages multiplied orotherwise increased. All issues and questions concerning the construction,validity, interpretation and enforceability of these Official Rules, or therights and obligations of participants and Sponsor in connection with theSweepstakes, shall be governed by, and construed exclusively in accordancewith, the laws of the province of Ontario, without giving effect to any choiceof law or conflict of law rules (whether of the province of Ontario or anyother jurisdiction), which would cause the application of the laws of anyjurisdiction other than the province of Ontario.
13. USE OF PERSONALINFORMATION: The name, e-mail address, and other informationprovided by an entrant will be used by the Sponsor for use in winner selection& notification in accordance with the Official Rules. Additionally,Sweepstakes entrants’ information provided may be used by the Sponsor forproduct research purposes. Also, Sponsor may contact entrants for marketingpurposes via all media types including but not limited to e-mailcorrespondence. The handling of personal information by Sponsor is pursuantto its privacy policy which may be found at www.jeanmachine.com. Byparticipating in the Sweepstakes, entrants hereby agree to Sponsor’s collectionand usage of their personal information and acknowledge that they have read andaccepted Sponsor’s privacy policy.
